Startup India (DPIIT) Recognition: Benefits and Process

DPIIT recognition gives an eligible startup access to tax and compliance benefits. Here is how eligibility works and what you get.

By Legal Munshi Expert Desk

Startup India is a government initiative that recognises eligible young businesses and gives them access to a set of benefits. The recognition itself is issued by the Department for Promotion of Industry and Internal Trade.

What counts as a startup

The definition has several parts. The entity must be a recognised form such as a private limited company, LLP or registered partnership, it must be within the age limit set by the government since incorporation, and its turnover must be below the prescribed threshold. The business must be working towards innovation, development or improvement of products or services, and it must not have been formed by splitting up or reconstructing an existing business.

How to apply

Recognition is applied for online on the Startup India portal. You will need the entity's incorporation details, information about the founders, a brief description of the business and how it is innovative, and supporting documents. Once granted, the recognition number is issued and can be used to claim the benefits.

The benefits

Recognised startups can apply for tax benefits, subject to the conditions and approvals set out in the scheme, and get access to easier compliance such as self-certification under certain labour and environment laws. They also gain access to government tenders on relaxed terms, and to a range of funding and mentorship programmes.

Tax benefits are conditional

It is important to understand that recognition does not automatically grant every tax benefit. Some benefits require a separate application and approval by an inter-ministerial board, and they are subject to the conditions in force at the time. Confirm the current position before relying on a benefit for planning.

Keeping the recognition

The recognition can be revoked if the entity ceases to meet the eligibility conditions or if the information provided is found to be incorrect. Keeping the entity's filings and turnover within the prescribed limits is what keeps the recognition valid.

The wider point

Recognition is most useful at the stage when a business is raising money or bidding for work, because it is a recognised signal of eligibility. Applying early, while the entity is clearly within the age and turnover limits, is usually simpler than applying later.
